This week, a look at some recent court rulings on campus free speech and expression. In some cases, campus visitors fought to assert their First Amendment Constitutional religious freedom rights while the campuses sought to place limits on campus speech to maintain a reasonable learning environment.

Out of the Courts: Taxing Requirements of Exemptions

Many campuses take advantage of a tax exempt status, either for the institution itself or for auxiliary service corporations or other campus organizations. Most are exempt from federal taxation under the Internal Revenue Service Code’s Section 501 (c) 3. What do institutions, campus corporations, and others need to do to maintain this status and the obvious and important benefits attached to it?

Key Case: Administrator's Right to Remain Silent?

The 17-year-old student said that while intoxicated, a basketball player had attacked her. She had been so drunk and sick that hospitalization was required. But her complaint apparently was not the first that year or even the first with the suspected student athlete. Two earlier incidents, similar in nature, had been reported to the dean of students. She had responded to the students, but had respected their requests to keep the matters quiet. They did not want to pursue criminal charges and asked that their reports be held in confidence. The dean of students was later arrested.
