Academic Institutions Go “Three for Three€ In Copyright and Fair Use Lawsuits

In an order dated October 10, 2012, federal district court Judge Harold Baer Jr. handed HathiTrust and its partner universities a copyright and fair use win on certain features of their digital repository project.  This puts academic institutions at “three for three” in recent and closely watched lawsuits challenging a variety of educational and scholarly practices.  In other cases, Georgia State University scored a significant victory relative to posting book chapters to its e-reserve and uLearn systems, while UCLA prevailed in a battle in relation to digitizing and streaming videos to students enrolled in particular courses.
